Kudos to Eugene personal injury lawyer Don Corson for a large Lane County jury verdict for a client of his injured by the malpractice of a physician who gave his client too much medication causing a brain injury.
This poor man must spend the rest of his life in constant care. The Lane County Oregon jury awarded him $6,445,499.92 for that long-term care and other economic damages including past and future lost wages and earning capacity.
The Lane County jury also awarded $5.75 million for non-economic damages associated with pain and suffering and the loss of the enjoyment of life.
Of course, malpractice insurance will cover this and this is what insurance is for. Lawsuits like this have the effect of causing folks to be more careful. We wonder if there were any settlement offers and why this wasn’t settled by the insurer.
Personal injury attorneys take on great financial risk to assist clients who cannot afford to hire an attorney by the hour. The lawyer postpones payment for often several years and the payment is not even guaranteed. Also, a quality personal injury law firm must have a war chest from which it can fund litigation costs that can reach upwards of $100,000 or much more on major injury claims.
